Terms and Conditions for Parents/ Guardians and Students

1. General Terms

1.1 By enrolling in classes at Big Brain Energy, parents and students agree to abide by the following terms and conditions.

1.2 Big Brain Energy reserves the right to make changes to the schedule, teachers, or curriculum with reasonable notice to parents and students. 

1.3 Under unforeseen circumstances such as sickness or emergencies on the part of the tutor for a scheduled class, another tutor will be assigned to take over the class. The class will proceed as normal and will be subject under the same terms and conditions as in Section 4: Booking and Cancellation of Classes.

1.4 If a class is cancelled by the tutor due to extenuating circumstances or inability to find a replacement tutor, the credit used to book the class will be refunded to the student's account.

2. Responsibility for Physical Injury and Personal Belongings

2.1 Big Brain Energy shall not be held responsible for any physical injury to self or damage to or loss of personal belongings incurred by students while on the premises, including interactions with the centre cat.

3. Complimentary Snack Bar

3.1 Big Brain Energy provides a complimentary snack bar for students. This includes typical drinks, snacks, and dairy ice cream. 

3.2 Parents and students acknowledge that consuming food and drinks from the snack bar is at their own risk. Big Brain Energy shall not be liable for any health problems arising from the consumption of these snacks.

4. Booking and Cancellation of Classes

4.1 Package Model

Classes under the Package Model are booked individually as per the student's convenience. 

4.2 Cancellation and Makeup Lessons for Package Model:

4.2.1 Classes must be booked at least 1 day in advance. Same-day bookings are subjected to availability. 

4.2.2 Cancellations must be made at least 2 days before the scheduled class. Cancellations made after this period will not be accepted and will be billable. 

4.2.3 No-Shows for scheduled classes will be considered billable and no refunds or credits will be issued. 

4.2.4 In case of a missed class due to accepted cancellation, a makeup lesson must be scheduled within two weeks, subject to availability in the existing schedule.

4.2.5 Makeup lessons must be scheduled in a class that the student can join from the existing schedule. No additional classes or timeslots will be opened to accommodate makeup lessons. 

4.2.6 If the student is unable to attend the makeup lesson, the lesson will be considered billable. 

4.2.7 There is strictly no refunds on unused or expired credits. 

4.3 Subscription Model

Classes under the subscription model offer students the most value for reserving a seat in weekly classes.

4.3.1 By opting for the subscription model, parents and students understand and agree to automatic renewal and charging of the credit card at the start of every month.

4.3.2 The subscription price is for 4 lessons, once a week for four weeks. The minimum commitment is for 3 consecutive months from the start of the subscription.

4.3.3 Students who cancel the subscription or place it on hold within the first 3 months will have their plans cancelled and will not be able to subscribe again. They may opt to purchase classes from the package model instead.

4.3.4 Cancelled classes under the subscription model will not be refunded, but makeup lessons can be scheduled within one week from the cancellation date, subject to availability in the existing schedule. No additional classes or timeslots will be opened up to accommodate makeup lessons under the subscription model.

4.3.5 Makeup lessons for cancelled classes must be completed within one week of the cancellation date. If the cancellation was due to illness, makeup lessons must be completed within two weeks.

4.3.6 Holds on the subscription can be initiated after the initial 3-month commitment period. Each hold must be communicated with one month's notice. For example, to pause the subscription for April, notice must be given by March 1st.

4.3.7 No refunds will be issued for charges incurred due to late notice for holds.

4.3.8 Parents understand that pausing subscriptions does not guarantee a seat when they resume the subscription.

4.3.9 Subscription can be cancelled after the initial 3-month commitment period by giving 1 months’ notice, without penalty.

5.1 Intellectual Property Rights

5.1.1 Ownership: All materials, resources, and content provided by Big Brain Energy (the "Centre"), including but not limited to notes, worksheets, presentations, and other educational materials (collectively, the "Materials"), are the exclusive intellectual property of the Centre. These Materials are protected by copyright and other applicable intellectual property laws.

5.1.2 Use of Materials: The Materials are provided solely for the personal educational use of the enrolled students and their parents or guardians. Reproduction, distribution, or modification of these Materials for purposes other than personal educational use is strictly prohibited.

5.2 Prohibition on Commercialisation 

5.2.1 Non-Commercial Use: Students and parents/ guardians are strictly prohibited from selling, transferring, or otherwise commercialising the Materials, either online or offline, including but not limited to marketplace, auction sites, and social media platforms.

5.2.2 No Profit from Materials: Selling or attempting to sell the Materials for a profit is expressly forbidden. This includes, but not limited to, the resale of notes, practice papers, and other educational resources by the Centre.

5.3 Consequences of Violation

5.3.1 Enforcement: In the event of a breach of this policy, the Centre reserves the right to take appropriate legal action, including but not limited to seeking injunctive relief and/or damages. The Centre may also terminate the student's enrolment and/or access to the Materials.

5.2.2 Liability: Any cost, losses, or damages incurred by the Centre as a result of a breach of this policy by the student or parent/guardian shall be the responsibility of the offending party.

6. Miscellaneous 

6.1 Parents/ guardians and students are responsible for keeping themselves informed of any updates or changes to these terms and conditions. 

6.2 Big Brain Energy reserves the rights to refuse service to anyone not complying with these terms and conditions or disrupting the learning environment of other students. 

7. Acknowledgement and Agreement

7.1 Acknowledgement: By enrolling in the Centre or accessing the Materials, students and parents/guardians acknowledge that they have read, understood, and agreed to abide by the terms set out in this document.
